Regulations on the study of the citizens of Turkmenistan in the higher and vocational educational establishments of the foreign countries
1. This Regulations coordinate the order of studying the citizens of Turkmenistan in the higher and vocational educational establishments of the foreign countries.
2. By the referral of the ministries, sectoral institutions, velayat and Ashgabat hyakimliks (regional or city councils), as well as in private the citizens of Turkmenistan may go to study by all forms (full-time, full-time and extramural, tuition by correspondence) of getting education in the higher and vocational educational establishments of the foreign countries.
The citizens going to study in the higher and vocational educational establishments of the foreign countries can obtain information on the order of going to the study in the foreign countries, as well as on the higher and vocational educational establishment where they are going to study in the Ministry of Education of Turkmenistan or Ashgabat and velayat Main Educational Departments.
3. The citizens of Turkmenistan are sent to study in the higher and vocational educational establishments of the foreign countries by the following:
- In accordance with the interstate (intergovernmental) agreements – by the Ministry of Education of Turkmenistan, as well as agreements of the Ministry of Education of Turkmenistan concluded with the appropriate institutions, organizations of the foreign countries, international organizations and funds;
- By the ministries, sectoral institutions of Turkmenistan, velayat and Ashgabat hyakimliks – in accordance with the legislation of Turkmenistan on the basis of the direct agreements concluded with foreign and international organizations, institutions and funds, as well as the higher and vocational educational establishments of the foreign countries;
- By the non-governmental enterprises and organizations – in private.
The citizens of Turkmenistan may go to study in the higher and vocational educational establishments of the foreign countries in private.
4. Agreement on the mutual duties and rights of the parties, conditions of studying in the educational establishment is concluded between the parties sending the citizens of Turkmenistan to study in the higher and vocational educational establishments of the foreign countries and the citizen of Turkmenistan who is being sent to study, its form is approved by the Ministry of Education of Turkmenistan.
5. In accordance with the second and third items of the 3rd part of this Regulations, on the basis of the interstate, intergovernmental and inter-branch agreements, together with the appropriate ministries and sectoral institutions, velayat and Ashgabat hyakimliks and Main Educational Departments the Ministry of Education of Turkmenistan selects the citizens of Turkmenistan being sent to study in the higher and vocational educational establishments of the foreign countries in the established order on the competitive basis and sends them to study.
Announcement, holding competition and selection of the citizen of Turkmenistan who is being sent to study in the result of it are carried out in the order of admission to the higher and vocational educational establishments of Turkmenistan, if other is not stipulated in the international agreements of Turkmenistan.
If check of the educational level of the citizen of Turkmenistan being sent to study in the higher and vocational educational establishments of the foreign countries is determined as the condition in the international agreement of Turkmenistan, the representatives of the diplomatic missions, consular offices, international organizations and funds of the appropriate foreign countries in Turkmenistan participate in the competition.
The candidates who took prize-winning places in the international and state competitions in different subjects have the preferential right in the selection of the citizens of Turkmenistan to study in the higher and vocational educational establishments of the foreign countries on the competitive basis.
6. In accordance with the international agreements of Turkmenistan age limitations of the citizens of Turkmenistan who will be sent to study in the higher and vocational educational establishments of the foreign countries are imposed according to the conditions of places given to the students by the parties admitting to study.
7. The number of the citizens of Turkmenistan going to study in the higher and vocational educational establishments of the foreign countries in private, term of study, amount of payment is not restricted.
8. For the purpose of safeguarding of the citizens of Turkmenistan going to study in the higher and vocational educational establishments of foreign countries, determining their specialties and planning to provide them with workplaces, they are registered by the Ministry of Education of Turkmenistan (including Internet-based registration).
9. The citizens of Turkmenistan who came to study in the higher and vocational educational establishments of the foreign countries get education in the educational establishments in accordance with the established order. They should observe the rules and internal order of the educational establishment.
10. In accordance with the legislation and international law of Turkmenistan the citizens of Turkmenistan studying in the higher and vocational educational establishments of the foreign countries use protection of Turkmenistan.
The citizens of Turkmenistan studying in the higher and vocational educational establishments of the foreign countries are registered in the diplomatic missions or consular offices of Turkmenistan in foreign countries for their safeguarding.
11. The citizens of Turkmenistan studying in the higher and vocational educational establishments of the foreign countries are obliged to respect legislation, national values of the countries where they stay, not to be engaged in any illegal activities and not to participate in such activities, as well as not to commit the acts that can harm authority of Turkmenistan.
12. The citizens of Turkmenistan studying in the higher and vocational educational establishments of the foreign countries can do teaching and work practice in the enterprises and institutions of Turkmenistan.
13. The state is not responsible for financing studies of the citizen of Turkmenistan in the higher and vocational educational establishments of foreign countries if other is not stipulated in the international agreements of Turkmenistan.
14. Financial expenses connected with the study of the citizens of Turkmenistan in the higher and vocational educational establishments of foreign countries (tuition fee, expenses for living in the hostel, medical insurance and transport charges from Turkmenistan to the place where educational establishment is located and return) can be paid fully or by the certain types of the costs in accordance with the requirements of the concluded agreements at the expense of the following:
a) on the basis of the international agreements of Turkmenistan at the expense of means allocated from the State Budget of Turkmenistan to the Ministry of Education of Turkmenistan, other ministries, sectoral institutions and velayat and Ashgabat hyakimliks for the study of the citizens of Turkmenistan in the higher and vocational educational establishments of the foreign countries, as well as own means of the ministries, sectoral institutions;
b) at the expense of the scholarships granted to Turkmenistan by the governments of foreign countries, international organizations and funds;
c) at the expense of the own means of the non-governmental enterprises and organizations, as well as private persons;
d) at the expense of the own means of the organization and individuals.
Types of the financial expenses that will be paid for the student should be determined in detail in the agreement concluded with the student who will be sent to study.
15. Recognition in Turkmenistan of the documents on education issued to the citizen of Turkmenistan by the higher and vocational educational establishments of foreign countries is carried out in accordance with the legislation and international agreements of Turkmenistan.
