The Government of Turkmenistan and the Government of the Republic of Kazakhstan, hereinafter referred to as the Parties, Basing on the Agreement on Friendship and Cooperation between Turkmenistan and the Republic of Kazakhstan dated May 19, 1993, expressing a desire to assist the further development and deepening of bilateral cooperation in the field of education and science, in order to establish rules for the mutual recognition of official documents on education, academic degrees and academic titles
agreed on the following:
Article 1
This Agreement establishes the procedure for the recognition of official state documents issued by educational institutions of full-time education, official documents on the award of academic degrees and academic titles in Turkmenistan and the Republic of Kazakhstan.
Article 2
Official documents of the state standard on general secondary education issued in Turkmenistan, official documents of the state standard on general secondary education issued in the Republic of Kazakhstan, the Parties mutually recognize when continuing education at a subsequent level in accordance with the current legislation of the States of the Parties.
Article 3
The Parties will mutually recognize diplomas and certificates of graduation from vocational educational institutions for the training of mid-level specialists and workers in Turkmenistan and diplomas of graduation from vocational educational institutions in the Republic of Kazakhstan, subject to the duration and content of vocational training for continuing education, as well as for employment in accordance with assigned qualification.
Article 4
Subject to the duration and content of training in the specialty in higher educational institutions of the Republic of Kazakhstan, Turkmenistan recognizes the diplomas issued by them on the professional degree of “bachelor”, “specialist”, and “master”, corresponding to diplomas issued in Turkmenistan, which give the right to continue education, as well as for employment in accordance with the assigned qualifications.
Article 5
If the duration and content of training in the specialty in higher educational institutions of Turkmenistan correspond to their respective terms of study, the Republic of Kazakhstan recognizes diplomas corresponding to diplomas issued in the Republic of Kazakhstan with the assignment of a professional degree of “bachelor”, “specialist” and “master”, as well as granting the right for continuing education and for employment in accordance with the assigned qualifications.
Article 6
The Parties recognize official documents on higher education in accordance with the national legislation of their states.
Article 7
The Parties recognize, in accordance with the national legislation of their states, diplomas of conferring the degree of candidate of sciences and doctor of sciences, issued by the state authority of Turkmenistan and the state authority of the Republic of Kazakhstan.
Article 8
Certificates of conferring the academic titles of associate professor and professor issued in Turkmenistan, certificates of conferring the academic titles of associate professor and professor issued in the Republic of Kazakhstan are mutually recognized in accordance with the current legislation of the States of the Parties.
Article 9
Authorities for the implementation of the provisions of this Agreement:
a) from Turkmenistan – the Ministry of Education of Turkmenistan and the Supreme Council for Science and Technology under the President of Turkmenistan;
b) from Kazakhstan – the Ministry of Science and Education of the Republic of Kazakhstan.
When changing the name or functions of the above authorized bodies, the Parties shall be notified in a timely manner through diplomatic channels.
Article 10
To implement this Agreement, the Parties will transfer to each other samples of state official documents on education, on awarding academic degrees and academic titles, other regulatory legal acts regulating the rules and procedures for their registration and issuance, as well as a list of educational institutions related to this Agreement.
Article 11
The Parties will exchange views on the implementation of this Agreement, inform about changes in the education system of their states, about the requirements for naming and issuing official documents on education, about academic degrees and titles, and, if necessary, will send each other relevant official explanations.
Article 12
Disagreements on the interpretation and application of the provisions of this Agreement shall be resolved by the Parties through consultations and negotiations.
Article 13
By mutual arrangement of the Parties, this Agreement may be amended, which are an integral part of this Agreement and are formalized by separate Protocols.
Article 14
This Agreement is provisionally applied from the date of its signing and enters into force from the date of receipt of the last written notice of the conduct of internal state procedures necessary for its entry into force.
This Agreement is concluded for an indefinite period and shall remain in force until the expiration of twelve months from the date of sending one of the Parties a written notice to the other Party of its intention to terminate the Agreement.
Signed in the city of Astana on July 5, 2001 in duplicate in the Turkmen, Kazakh and Russian languages, the texts of which have the same legal force.
For the interpretation of the provisions of this Agreement, the text in Russian will apply.
